Liability and application scope

The Portuguese Environment Agency (APA) is committed to protecting the privacy of any personal data it may collect in the various areas of operation of this website, particulary that required by law or contract.

This document aims to establish the privacy policy implemented and ensured by APA, describing the relevant points regarding the collected data: including its purposes, access, and other relevant details.

 

Data collection

The data provided may be collected, processed, and stored if had been expressly authorized by APA. Data collection, including personal data, is collected during interactions with APA, namely:

  • Data request;
  • Data and/or documentation download;
  • In-person and/or online events management;
  • Periodic requests for updated data.

Depending on the nature of the interaction, only if it is necessary, APA may request certain personal data. Any request for data will always be made in accordance with legal requirements to obtain statistical information regarding the number of users, their interaction level on the website, and the data previously provided.

 

Why do we collect personal data?

A APA recolhe e processa dados pessoais estritamente necessários, os quais são apenas solicitados quando relacionados com o propósito em causa, de acordo com o seu consentimento para fins legítimos, tais como:

  • Fornecer uma resposta adequada e direcionada aos pedidos de informação/proposta;
  • Comunicar melhor consigo, para assuntos relevantes e apenas com a frequência necessária, segundo a caraterização dos seus dados e das suas preferências;
  • Cumprir com propósitos do sítio e do financiamento obtido junto de fundos nacionais e comunitários, nomeadamente dados estatísticos para melhoria do desempenho da informação prestada.

Sempre que não exista uma obrigação legal específica, os dados pessoais são tratados pela APA apenas pelo período de tempo necessário para a realização da finalidade definida. Os períodos de conservação dos dados pessoais podem mudar significativamente quando estejam em causa fins de arquivo de interesse público, motivos históricos, científicos ou estatísticos, comprometendo-se a APA a adotar as medidas de conservação e segurança adequadas.

 

Data sharing

Personal data may be communicated by APA to third parties, ensuring that they process such data solely and exclusively for the indicated purposes. Where applicable, we share user information with contracting entities for contractual compliance purposes.

The processing of personal data may be carried out by a reputable service provider contracted by APA. The service provider will process the data exclusively for the purposes established herein and in accordance with the instructions issued by APA, strictly complying with legal regulations on personal data protection, information security, and other applicable regulations.

 

Data protection rights

Data holders may exercise their rights under the General Data Protection Regulation at any time, such as access, rectification, restriction, or erasure of personal data.

If a data holder makes any type of request regarding their data, proof of identification may be required for security and protection purposes. APA has not appointed a Data Protection Officer. APA will use a set of appropriate technologies and security procedures to protect personal data from unauthorized access, use, or disclosure.
